Terms of Service
Dream Ja - 夢想嘉" (hereinafter referred to as "the Service") is an online service developed and provided by 顏嘉賢 (hereinafter referred to as "Me"). Before applying to become a member of the Service, you should carefully read the Service Terms. Completing the registration process or commencing the use of any or all functions of the Service signifies that you have read, understood, and fully agreed to the Service Terms. If you have any objections or doubts regarding the Service Terms, you should immediately cease using the Service platform.
1. Use of Registered Member Accounts
1.1. The registration for this service is only available through the Google method, and this service only retains Google IDs and related authorization data.
1.2. When registering for the Service, if the user is a minor under twenty years old, he/she should register as a member only after his/her parents (or legal representatives) have read, understood, and fully agreed to the Service Terms. If there is any incomplete or untrue registration information, it will be regarded as a violation of the Service Terms, and the Service has the right to terminate the Service to the member immediately, and the member cannot make any claims to the Service or me.
1.3. The member guarantees that they are the rightful owner of the account for this service. In order to protect the rights and interests of the member, please do not provide the account to others for use. If the member suspects that the account may be compromised, please notify the service immediately. The service will promptly suspend the use of the account. In the event of unauthorized use, improper use, or damage that cannot be determined whether it is caused by the member's usage, I assumes no responsibility for any compensation for damages.
1.4. Except for providing to the judiciary, investigation and prosecution authorities, related competent authorities, or for the necessary use of the Service to carry out related activities, the Service will not arbitrarily provide members personal data to third parties.
1.5. If a member makes a false claim and causes damage to the rights of my company or a third party, he/she should bear all legal responsibilities.
2. Provision of Services
2.1. Members should prepare necessary personal computers, mobile phones, communication equipment, operating systems, communication methods, and electricity for the use of the Service at their own expense and responsibility.
2.2. When I deem it necessary, I may change all or part of the content of the Service without prior notice to members.
2.3. Should I temporarily suspend all or part of the Service in order to maintain the related systems and hardware/software equipment of the Service, no separate announcement will be made, and I shall not be responsible for any losses incurred during this period.
3. Business Partner Services
3.1. The Service may contain services or content provided by other businesses that cooperate with me. The responsibilities that should be borne by such services or content are generally borne by the service or content provider. In addition, the terms of use and other conditions stipulated by the service or content provider may apply to such services or content.
4. Prohibited Acts
4.1. Members shall not engage in the following acts when using the Service:
4.1.1. Acts that violate laws, court judgments, decisions or orders, or legally binding administrative measures.
4.1.2. Acts that may endanger public order or good morals.
4.1.3. Acts that infringe on the copyrights, trademark rights, patent rights, or other intellectual property rights, reputation rights, privacy rights, or other legal or contractual rights of me or a third party.
4.1.4. Acts of posting or transmitting content with excessively violent expressions, excessively explicit sexual expressions, expressions related to discrimination based on race, nationality, religion, gender, social status, or family background, expressions that encourage or promote suicide, self-harm, or drug abuse, or other antisocial expressions that make people feel uncomfortable.'
4.1.5. Acts of impersonating me or a third party or deliberately disseminating false information.
4.1.6. Acts of exchanging the right to use the content for cash, property, or other economic benefits in a way other than specified by me.
4.1.7. Acts for the purpose of marketing, promotion, advertising, solicitation, or other profit-making activities (except with my consent), acts for the purpose of sexual or obscene activities, acts for the purpose of getting acquainted or interacting with strangers of the opposite sex, acts for the purpose of harassing or defaming other members, or other acts of using the Service for purposes different from the intended use of the Service.
4.1.8. Acts of providing benefits or other assistance to antisocial forces.
4.1.9. Acts of persuading participation in religious activities or religious groups.
4.1.10. Acts of improperly collecting, disclosing, or providing personal information, registration information, usage records, etc. of others.
4.1.11. Acts of interfering with the servers or network systems of the Service, improperly operating the Service using bots, cheating tools, or other technical means, intentionally exploiting vulnerabilities in the Service, connecting to the Service after altering terminal devices using rooting or jailbreaking, or other acts of making undue inquiries or requests to me, such as repeatedly asking the same question beyond the necessary limits, or other acts that interfere with the operation of the Service by me or the use of the Service by other members.
4.1.12. Acts that support or promote any of the acts described in Articles 4.1.1. to 4.1.11.
4.1.13. Any other acts that I deem inappropriate.
5. Member Responsibilities and Rights
5.1. Members shall use the Service at their own risk and shall be solely responsible for all actions and consequences arising from their use of the Service.
5.2. Handling of Violations of these Terms and other Management Rules
5.2.1. Unless otherwise specified in these Terms, in cases where there is sufficient evidence that a member has violated these Terms or other management rules while using the Service, I may take measures, including but not limited to account suspension or deletion.
5.3. Right to Appeal
5.3.1. Members reporting complaints about third-party plug-in programs or other actions that affect the fairness of using the Service will be handled in accordance with Section 5.2.1.
5.3.2. If a member maliciously files a complaint with us, or maliciously instructs a third party to file a complaint, causing us to suffer any direct or indirect damages, the member shall compensate us for such damages immediately upon our request.
6. Disclaimer
6.1. We do not warrant, either expressly or impliedly, that the Service (including the Content) is free of factual or legal defects (including defects in safety, reliability, accuracy, completeness, effectiveness, suitability for specific purposes, security, errors, or program errors, infringement of rights, etc.). We have no obligation to remove such defects before providing the Service to members.
6.2. We shall not be liable for any damages caused to members by the Service. However, if the contract related to the Service between us and the member (including these Terms) is a consumer contract under the applicable consumer contract law, this disclaimer shall not apply.
6.3. We are not responsible for any disputes between members or any third parties and do not guarantee any information provided by the Service.
6.4. We cannot guarantee the accuracy of any content provided to members by the Service. If a member's rights are damaged due to incorrect content or failure to update in a timely manner, we shall not be liable for any damages suffered by the member.
6.5. Members shall bear legal responsibility for their actions while using the Service. If we are required to assume any administrative, civil, or criminal liability due to the actions of a member, the member agrees to compensate us for the damages we have suffered.
6.6. If we suspend all or part of the Service to maintain the relevant systems and software and hardware equipment, and if this causes any damage, we shall not be liable for any compensation.
6.7. In the event that a member is unable to connect and use the Service due to reasons attributable to me, I will make efforts to promptly rectify or repair the issue, but cannot guarantee complete rectification or repair, as well as the time it takes to do so. I shall not be liable for any damages incurred by the member during the period of inability to use the Service.
6.8. We shall not be liable for any damages caused by the destruction or abnormal operation of computer systems or electromagnetic records.
6.9. I may not provide assistance in resolving disputes between members and third parties arising from the sharing of accounts, delegation of operation to others, or other reasons.
6.10. The Service uses electronic documents as the method for expressing intentions such as notifications, agreements, or confirmations related to the use of the Service, and their effectiveness is equivalent to that of written documents.
7. Governing Law and Jurisdiction
7.1. Matters not covered by these Terms of Service shall be governed by the laws of the Republic of China. In the event of a dispute arising from the use of the Service Platform that requires litigation, both parties agree, unless otherwise provided by law, that the Taiwan New Taipei District Court shall be the court of first instance.
8. Revision of Terms of Service
8.1. In response to changes in social environment and legal regulations and advancements in technology, the Service reserves the right to modify these Terms of Service at any time. Members are advised to review the revised Terms of Service on their own after the effective date. If a member continues to use the Service after the effective date, it is considered that they have agreed to accept the revised Terms of Service. If a member does not agree to all or part of the revisions, they should stop using the Service immediately.
